Privacy Policy

This explains what we collect, why, who touches it, and what you can ask us to do about it. It is written to be read. If anything is unclear, email [email protected] and ask before you sign up.

1Who we are

1.1 FemTech is operated by Ashley Alexander, doing business as The Fempowered Professional ("FemTech," "we," "us," or "our"). We provide a branded business software platform built within the HighLevel, Inc. platform, together with our own configurations, templates, automations, training, and support. 1.2 This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, and what choices you have. It forms part of the Agreement described in our Terms of Service. 1.3 If you have a question about anything in this policy, email [email protected] and ask. We would rather answer than have you guess.

2Two different kinds of data

2.1 This distinction matters, so we are putting it first. There are two separate categories of personal information involved when you use FemTech, and we treat them differently. 2.2 Your data. Information about you as our customer: your name, email, billing details, and how you use the Platform. For this information we are the controller. This policy describes what we do with it. 2.3 Your contacts' data. Information about your own leads, clients, students, and subscribers that you upload to or collect through your account. For this information you are the controller and we are a processor acting on your instructions. We do not use your contacts' data for our own purposes, we do not sell it, and we do not market to your contacts.
In plain terms: your customer list is yours, not ours. We hold it so your account works. We do not borrow it.

3What we collect

3.1 Account information. Your name, business name, email address, phone number, and password (stored hashed, never in readable form). 3.2 Billing information. Your subscription status, billing history, wallet balance, and usage charges. Card numbers are handled by our payment processors and are not stored on our systems. 3.3 Content you create. Pages, funnels, emails, automations, courses, forms, and other material you build inside the Platform. 3.4 Contact data you import or collect. Whatever you choose to bring into your CRM or gather through your forms, calendars, and checkouts. 3.5 Communications. Messages you send us through support chat, email, or the community, and messages sent through the Platform where retention is needed to deliver the service. 3.6 Usage and device information. Log data, IP address, browser and device type, pages viewed, and actions taken inside the Platform. This is used to keep the service running, secure, and improving. 3.7 We do not knowingly collect special category data (such as health, biometric, or financial account information beyond billing) about you. If you choose to store such data about your own contacts, you are responsible for having a lawful basis to do so.

4How we use it

4.1 To provide the Platform: create and maintain your account, deliver the features you pay for, and keep your data available to you. 4.2 To bill you: process subscription payments, calculate usage charges, maintain your wallet balance, and handle auto top-up as described in our Terms. 4.3 To support you: answer your questions, troubleshoot problems, run onboarding and migration, and deliver Tech Girly School. 4.4 To communicate with you: send service notices, billing notices, security alerts, product updates, and training announcements. Service and billing messages are not optional while you have an account. Marketing messages are, and you can opt out of those at any time. 4.5 To keep the Platform secure and lawful: detect abuse, prevent fraud, enforce our Terms, and comply with legal obligations. 4.6 To improve the Platform: understand which features get used and where people get stuck. Where we do this we work with aggregated or de-identified information wherever it will answer the question. 4.7 We do not sell your personal information, and we do not sell your contacts' personal information. We do not share it with third parties for their own independent marketing.

5Who we share it with

5.1 We share personal information only with service providers who help us run the Platform, and only to the extent they need it. The main ones are listed below. 5.2 HighLevel, Inc. The Platform is built within HighLevel's software. HighLevel hosts and processes account data and content on our behalf, using cloud infrastructure operated by Google Cloud and Amazon Web Services. 5.3 Payment processors. Stripe, and where you choose to connect them, PayPal or Square, process payments and store card details under their own privacy policies. We receive confirmation and limited transaction detail, not full card numbers. 5.4 Communication providers. Where you send email, SMS, or place calls through the Platform, the underlying delivery providers used by HighLevel process that traffic in order to deliver it. 5.5 Integrations you choose to connect. If you connect a calendar, an accounting tool, a social account, or an automation service such as Zapier or Make, data flows to that service under its own terms. Those connections are yours to make and yours to revoke. 5.6 Legal and safety. We may disclose information where we are legally required to, or where it is necessary to protect our rights, our users, or the public. 5.7 Business transfer. If FemTech is ever sold or merged, account information may transfer as part of that transaction. You would be notified before any transfer of your information to a new controller.

6Cookies and tracking

6.1 We use cookies and similar technologies to keep you logged in, remember your preferences, keep the Platform secure, and understand how the site and Platform are used. 6.2 Strictly necessary cookies cannot be turned off without breaking core functionality such as staying signed in. 6.3 Analytics and advertising technologies, where used, help us understand traffic and measure marketing. You can control these through your browser settings and, where offered, through the cookie banner on our site. 6.4 Any cookies set inside pages and funnels that you build for your audience are your responsibility, including any consent notice your jurisdiction requires.

7Where your data lives

7.1 The Platform is hosted primarily in the United States. If you are located outside the United States, using FemTech means your information is transferred to and processed in the United States, which may have different data protection laws than your own country. 7.2 Where required, we rely on appropriate safeguards for international transfers, including the standard contractual clauses used by our providers.

8How long we keep it

8.1 We keep your account information and content for as long as your account is active. 8.2 After cancellation we retain account data for a limited period so that you can reactivate or retrieve an export, after which it is deleted or de-identified in the ordinary course. 8.3 We keep billing and transaction records for as long as tax, accounting, and legal obligations require, which is typically longer than the retention period for account content. 8.4 Backups persist for a limited window after deletion and are overwritten on a rolling basis.

9Your rights and your choices

9.1 Access and export. You can export your contacts, form submissions, and collected records from inside your account at any time, whether or not you are still subscribed. 9.2 Correction. You can correct your account information from inside your account, or ask us to. 9.3 Deletion. You can ask us to delete your personal information. We will do so unless we are required to keep it, for example for tax or legal reasons, and we will tell you if that is the case. 9.4 Marketing opt-out. Every marketing email has an unsubscribe link. Opting out of marketing does not stop service and billing notices, which are necessary while you hold an account. 9.5 Regional rights. Depending on where you live, you may have additional rights, including the right to object to or restrict certain processing, the right to data portability, the right to withdraw consent, and the right to complain to a supervisory authority. We honor these where they apply and we do not discriminate against you for exercising them. 9.6 To exercise any of this, email [email protected]. We may need to verify your identity before we act, because otherwise anyone could ask for your data.

10If you are one of our customers' contacts

10.1 If you received a message from a business that uses FemTech, that business, not FemTech, decides what to send you and holds the relationship with you. 10.2 Please direct requests to access, correct, or delete your information to that business directly. If you contact us, we will pass your request on to them and support them in handling it.

11Your obligations when you use FemTech

11.1 When you collect and store other people's personal information in your account, you are the controller of it. You are responsible for having a lawful basis to collect it, for honoring consent and unsubscribe requests, and for complying with the marketing and privacy laws that apply to you and to the people you contact. 11.2 This includes anti-spam and telemarketing rules such as CAN-SPAM, CASL, TCPA, and GDPR where applicable, as set out further in our Terms of Service. 11.3 You need your own privacy policy for your own business. The one you are reading covers FemTech's handling of data, not yours.

12Security

12.1 We rely on the security controls of the underlying platform and infrastructure providers, including encryption in transit, access controls, and hashed credential storage. 12.2 You are responsible for your side of it: keeping your password private, using a strong and unique one, managing who you grant team access to, and removing access when someone leaves. 12.3 No system is perfectly secure, and we cannot guarantee absolute security. If a breach affects your personal information we will notify you as required by law.

13Children

13.1 FemTech is intended for use by adults running a business, and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with information, email [email protected] and we will delete it.

14Changes to this policy

14.1 We may update this Privacy Policy. When we do, we will change the "last updated" date at the top of this page. 14.2 If a change materially affects how we handle your personal information, we will give you notice by email or inside the Platform before it takes effect.
